General

These Terms of Use (“Terms”) govern your use of Voya.com, myVoya, myVoyage, and any website owned, operated or supported (collectively the “Sites”) by Voya Financial, Inc., or any of its’ subsidiaries or affiliates (collectively, “Voya,” “we” or “our”). Voya may modify these Terms at any time without notice, except where required by law. Any updates made to these Terms go into effect once they are posted. By continuing to use the Sites, you consent to any changes in these Terms.

Certain Voya Sites may contain separate terms and conditions, which are in addition to these Terms. By accessing such Sites, you agree to be bound by those additional terms and conditions. In the event of a conflict, those additional terms and conditions will govern your use of those Sites. You may be asked to execute supplemental agreements before you are permitted to access or use certain features or functionality (each, a “Supplemental Agreement”). In the case of Supplemental Agreements presented to you online, you authorize Voya to rely upon “checks” or “clicks” in designated locations as your electronic signature and your agreement to the terms and conditions of such Supplemental Agreements. These Terms are in addition to any Supplemental Agreement and are not intended to supersede or modify any such Supplemental Agreement.

Prospectus Information

Certain registered insurance products and mutual funds are offered for sale by prospectus only. To request prospectuses containing more complete information regarding registered products in your jurisdiction, including charges and expenses, please contact the appropriate Voya company identified on the Voya Site or its representative. Read each prospectus carefully before you invest or send money.

Intellectual Property License and Restrictions on Use

The Voya name, service marks, URLs and domain names, and the other trademarks, registered or not (collectively, “Marks”), appearing on the Sites are the property of Voya and/or its third-party service providers. All information, material and content accessible on or generated by the Sites, including, but not limited to, text, graphics, images, software applications and code, video, audio and user interface design (“Content”) are the intellectual property of Voya and/or its third-party service providers and are protected by United States and foreign trademark, copyright, trade secret, patent and other intellectual property laws.

Voya grants you a nonexclusive, limited, royalty-free, revocable license during the term of this Agreement to use the Sites strictly as set forth in these Terms and in any Supplemental Agreement. Voya reserves the right, in its sole discretion, to deny you access to the Sites, or any portion thereof, without notice and without reason. If you breach these Terms, your license to use the Sites shall immediately and automatically terminate.

Acceptable Use

You may use the Sites only for lawful purposes and in accordance with the Terms. You may print out a copy of the Content solely for your own personal, non-commercial use.

Access to and use of password-protected and/or secure areas of the Sites is restricted to authorized users only. Unauthorized persons attempting to access these areas of the Sites may be subject to legal action.

Conditional Use

You agree not to engage in any of the following during your use of Voya’s Sites without the prior express written consent of Voya, which may be withheld in Voya’s sole discretion:

  • Use any robot, spider, scraper, deep link or other similar automated data gathering or extraction tools, program, algorithm, artificial intelligence or methodology to access, acquire, copy or monitor the Sites or any portion of the Sites, other than via software that sends queries to the Sites to index or rank a website for search and location purposes;
  • Engage in actions involving items that infringe or violate any copyright, trademark, right of publicity or privacy or any other proprietary right under the law, including but not limited to use of Voya intellectual property, name, or logo, including use of Voya trade or service marks, or in a manner that otherwise harms Voya’s brand; or
  • Modify, obstruct, alter, remove or otherwise interfere with any of the Marks and Content on the Sites.

Prohibited Use

You agree not to engage in any of the following during your use of Voya’s Sites:

  • Violate any law, statute, ordinance or regulation;
  • Use or attempt to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search the Sites, other than the search engines and search agents available through the Sites and other than generally available third-party web browsers;
  • Post or transmit any file that contains viruses, worms, Trojan horses or any other contaminating or destructive features, or that otherwise interfere with the proper working of the Sites;
  • Any action that implies an untrue endorsement by or affiliation with Voya; or
  • Attempt to decipher, decompile, disassemble or reverse-engineer any of the software comprising or in any way making up a part of the Sites.

Any violation of this section, or for any reason, your access or use of the Sites may be terminated or restricted without notice, and without liability to you or anyone else. These Terms shall survive termination to the extent necessary for the enforcement of Voya’s rights and your obligations herein.

Relationship of the Parties

Nothing contained in these Terms or your use of the Sites shall be construed to constitute either party as a partner, joint venturer, employee or agent of the other party, nor shall either party hold itself out as such. Neither party has any right or authority to incur, assume or create, in writing or otherwise, any warranty, liability or other obligation of any kind, express or implied, in the name of or on behalf of the other party, it being intended by both parties that each shall remain independent contractors responsible for its own actions.

Third-Party Sites

Any content included from, or links to, sites owned or operated by a third party (“Third-Party Sites”) are for your convenience and informational purposes only and do not imply any affiliation with, or an endorsement, authorization, sponsorship or promotion of the Third-Party Site and content. Voya is not responsible for and does not control any content or other information from Third-Party Sites, which are governed by their own terms and conditions, proprietary rights and acceptable use policies. Voya does not independently verify the information provided by third parties, does not guarantee the accuracy, completeness, timeliness or correct sequencing of such information, and assumes no responsibility for Content displayed on the Voya Site that may be provided by another party. Voya is not liable for any damages incurred as a result of clicking on a link to any Third-Party Site or relying on, in any capacity, any Third-Party content.

Governing Law and Venue

These Terms and any Sites provided under them are governed by laws of the State of New York, without regard to its conflicts of law, and shall inure to the benefit of Voya’s successors and assigns, whether by merger, consolidation or otherwise. Except as provided for in the Arbitration Section, you hereby irrevocably consent to submit to the jurisdiction courts of New York for the purposes of pursuing any such action.

Arbitration

To the fullest extent permitted by law of the applicable jurisdiction, any dispute, claim or controversy arising out of or relating to the access and use of the Sites or these Terms, including the interpretation of this Arbitration Section, SHALL BE RESOLVED SOLELY BY FINAL AND BINDING INDIVIDUAL ARBITRATION. ALL CLAIMS ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR THESE TERMS MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ARISES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

Any arbitration shall take place in New York, NY, unless both parties agree in writing to a different location, and the Rules of Arbitration of the American Arbitration Association shall govern.

Class Action Waiver

YOU AND VOYA EACH FURTHER AGREE THAT EACH IS WAIVING THEIR RIGHT SUE EACH OTHER IN COURT, INCLUDING TO A TRIAL BY JURY, OR TO PARTICIPATE IN A CLASS ACTION. You and Voya agree that each may bring claims against the other only in your or its individual capacity, and not as a representative, part of a class, or consolidated action or proceeding. If a dispute is resolved through arbitration, the arbitrator may not consolidate another person’s claim with your claims and may not otherwise preside over any form of a representative or class proceeding.

Indemnification

You agree to indemnify, defend and hold harmless Voya’s agents, employees, officers, directors, successors and assigns (collectively, the “Indemnitees”) from and against any and all claims, liabilities, awards, losses, costs or fees (including reasonable attorney’s fees) arising out of or relating to your access to and use of the Sites, violation of these Terms or infringement of any intellectual property rights (collectively, “Claims”). Voya reserves the right to assume the exclusive defense and control of any Claims. You agree to reasonably cooperate as requested by Voya in the defense of any Claims and in any event may not settle any Claims without Voya’s prior written consent.

Content

Voya intends to provide accurate and up-to-date content on the Voya Sites. However, we make no warranty or representation that the information on the Voya Sites is complete, accurate, up-to-date or error-free, or that known defects will be corrected. Content, services, products or functions available on the Voya Sites may contain inaccuracies or errors and may be changed or updated at any time without notice. Voya has no obligation to update the Voya Sites, so information may be out-of-date at any given time. Voya does not guarantee that the Sites will operate error-free or that the platform, its servers or the Content are free of computer viruses or similar contamination or destructive features. If you choose to use the Sites, download any materials or rely on the information presented to or obtained by you, you do so solely at your own risk. THEREFORE, ALL CONTENT AND FUNCTIONS ON THE VOYA SITES, OR ANY OTHER SITE LINKED TO THE VOYA SITE, ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Some jurisdictions do not allow the exclusion of certain implied warranties in which event any required warranty applies to the minimum extent legally required.

Availability

No warranty or representation is made that the Voya Sites or any part or function, including without limitation any transactional function, will be available and not subject to interruption at any time.

Disabling Devices

No warranty or representation is made that any Content, service, product or function, including without limitation any downloadable files, available on the Voya Sites is free of computer viruses, malware or other destructive or harmful programs, software, code or devices that may erase, scramble, lock or disable any computer software, content or equipment or may prevent users from using a site or any other item of hardware or software. You should routinely scan your system and downloaded files for such disabling devices.

Third-Party Content

Voya may provide information on the Voya Sites supplied by third parties. Any opinions, advice, statements, services, offers or other information expressed or made available by a third party, are those of such third party and not Voya. Voya does not independently verify the information provided by third parties, does not guarantee the accuracy, completeness, timeliness or correct sequencing of such information, and assumes no responsibility for Content displayed on the Voya Site that may be provided by another party.

Limitation of Liability

IN NO EVENT WILL VOYA BE LIABLE TO YOU OR ANY OTHER PARTY FOR ANY DIRECT, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, ANY LOST PROFITS, BUSINESS INTERRUPTIONS, LOSS OF PROGRAMS OR DATA ON YOUR EQUIPMENT, OR OTHERWISE, EVEN IF WE OR ANY OF OUR REPRESENTATIVES ARE EXPRESSLY ADVISED OF THE POSSIBILITY OR LIKELIHOOD OF SUCH DAMAGES, ARISING OUT OF OR RELATED TO ANY USE OF OR INABILITY TO USE THE VOYA SITES, OR ANY THIRD-PARTY SITES OR OTHER LINKED SITE, INCLUDING, WITHOUT LIMITATION, USE OF OR RELIANCE ON CONTENT, INFORMATION, INTERRUPTIONS, ERRORS, DEFECTS, MISTAKES, OMISSIONS, DELETION OF FILES, DISABLING DEVICES, DELAYS IN OPERATION OR TRANSMISSION, NONDELIVERY OF INFORMATION, THEFT, UNAUTHORIZED ACCESS, DISCLOSURES OF COMMUNICATIONS, OR ANY FAILURE OF PERFORMANCE.

Some jurisdictions do not allow limitation or exclusion of certain liabilities or damages in which event in such jurisdiction the foregoing shall apply to the maximum extent allowed by law. You are responsible for the entire cost of all servicing, repair or correction of your property or operations, including without limitation your computer, network, software or any device, required as a result of or related to using the Voya Sites. In no event shall Voya’s total liability to you for damages, losses and causes of action of any kind — whether in contract, tort (including, but not limited to, negligence), strict liability or otherwise — exceed the amount paid by you, if any, for accessing the Voya Sites.

Assignment

Voya may freely assign, transfer and delegate these Terms or any rights and/or obligations hereunder without your consent.

Privacy

Any personal information provided to the Sites is subject to the Voya Privacy Notice. If you reside in a state that has adopted a comprehensive consumer privacy law, review our Supplemental State-Specific Privacy Notice for detailed information about the categories of personal information we collect and share, your individual rights as a consumer, and how you can contact Voya to exercise your rights. Voya does not sell personal information.

Non-Personally Identifiable Information You Voluntarily Provide

When you visit the Voya Sites we may collect demographic data, such as your date of birth, gender, ZIP code and other information that by itself does not constitute personal information. We may use such information for any purpose, including without limitation to enhance website security, detect broad demographic trends, provide content tailored to your interests, and otherwise enhance your experience on the Voya Sites. This information may also be shared with third parties on an aggregate basis.

Personal Information

Depending upon which Voya Sites you visit and which online services you use, the types of personal information we may collect from you could include your name, email address, mailing address, telephone number(s), account number(s), username and password. In addition, we may collect Social Security numbers, driver’s license or government-issued identification numbers, dates of birth, gender, health information, banking information, assets, and income, for you and your joint owners and beneficiaries, and other types of demographic and personal financial information when you provide such information on applications or forms or while using our online services and where we believe such information is reasonably required for ordinary business purposes. We may transmit certain of this information to third parties as necessary for our everyday business purposes, such as to maintain your account, process a transaction, or provide a service that you request while using our online services. We may also collect information about you from additional online and offline sources, including commercially available third-party sources such as credit reporting agencies. We may combine this information with the personal information we have collected from you under these terms. Additionally, we may aggregate personal information in a manner such that the end-product does not personally identify you, for example, by using personal information to display content according to your ZIP code. All personal information collected through the Voya Sites will be used and disclosed in accordance with the applicable Voya Privacy Notice and (as applicable) the Supplemental State-Specific Privacy Notice.

Security

Information sent through the internet may not be secure. Email services that may be provided through the Voya Sites generally are not encrypted and do not provide a secure and private means of communicating with us. Certain services offered on the Voya Sites do provide a secure means to communicate with us; this is indicated by an icon that appears on your screen when you are using such a service. For certain types of communications through the Voya Sites, or for access to certain portions of the Voya Sites, we may require the use of encryption technologies provided for your protection and/or require you to authenticate using user identification information (“UserID”), PIN/password and/or a form of multi-factor authentication. You are responsible for the confidentiality and use of your UserID and PIN/password and for securing the account or device you use for multi-factor authentication. If you become aware of any loss, theft or unauthorized use of your UserID, PIN/password, account or device you use for multi-factor authentication, Social Security number or account number, immediately notify the appropriate Voya company. While Voya may use reasonable precautions to protect confidential information and provide suitable security, we cannot guarantee that information transmitted through the internet is secure, or that such transmissions will be free from delay, interruption, interception or error. Please be aware that although passwords or other security protections may be in use, Voya reserves the right to monitor any and all transmissions, stored messages and routine backup copies of communications to ensure appropriate system usage.

Electronic Delivery of Information

General Information

If you have consented to conduct business with Voya electronically, or consented to the electronic delivery of documents, Voya may make certain regulatory documents and information relating to your Voya account(s) (such as statements, prospectuses and confirmations), collectively, “Information,” available electronically for download or via email.

SMS/Text Message Terms and Conditions

SMS/text messages (hereinafter referred to as “text messages”) are subject to the terms and conditions of your mobile carrier. Standard message and data rates may apply. Our Voya Privacy Notices apply to text message campaigns. We cannot guarantee timing or receipt of the text messages, as this may be affected by forces outside of our control. IN THE EVENT THAT A TEXT MESSAGE IS DELAYED OR NOT RECEIVED, VOYA IS NOT LIABLE FOR ANY RELATED IMPACTS.

If you elect to receive messages and alerts via text messages, we will periodically send text messages related to the various communications listed below. You may opt out of receiving future text messages from a Voya service by texting “STOP” at any time to the relevant number below. To re-subscribe, text “START” to the relevant number below.     • Your financial advisor is an investment adviser and registered representative of, and securities and investment advisory services are offered through, Voya Financial Advisors, Inc. (member SIPC). Do not communicate with your VFA financial advisor via text message if you have not received an opt-in text message and replied “YES.” You may opt out of receiving text messages from your financial advisor at any time. Email Unsubscribe

You may unsubscribe from marketing emails from Voya at any time. If you wish to do so, click on “Unsubscribe” at the bottom of the communication you wish to opt out of. You may also update your communication preferences in your online account profile or on the communication preferences page of the particular Voya Site at any time. Please note that the communication preferences apply only to marketing and educational emails and will not affect emails related to your Voya account(s).

U.S. Export Controls

Software is subject to United States export controls. No software may be downloaded or otherwise exported or re-exported (i) into (or to a national resident of) Cuba, North Korea, Iran, Syria or any other country to which the United States has embargoed goods, or (ii) to anyone on the U.S. Treasury Department list of Specially Designated Nationals or the U.S. Commerce Department Table of Deny Orders. You represent and warrant that you are not located in, under the control of, or a national resident of any such country or on any such list. You agree to comply with United States export control laws and that you will not transfer any software or other content from the Voya Sites in violation of United States export controls.

Product Offerings

The products and services described on the Sites are offered by the individual Voya companies or their distributors. The laws of each country, state or territory may differ, and not all products and services are available in all locations. Children

The Voya Sites are not intended to market any products or services to children under thirteen (13) years of age. We do not knowingly gather or solicit data from children under thirteen (13) years of age through the Voya Sites for marketing or other purposes. By using the Voya Sites, you represent that you are over the age of thirteen (13) years.

Execution of Transactions

If the Voya Sites permit you to access your account or conduct certain transactions (such as opening accounts, managing contributions and investment allocations, requesting loans or partial withdrawals, and updating personal information), you can only utilize those services by following the instructions stated within the appropriate password-protected log-on section of the Voya Site. When using the Voya Sites to execute transactions, problems may occur that are beyond Voya’s ability to correct. Access to the Voya Sites may be limited or unavailable during periods of peak demand, systems upgrading, maintenance or other reasons. If you are not able to complete your transaction due to a system failure, fail to receive written confirmation of a transaction or its execution within ten (10) business days after execution, or receive confirmation of a transaction you did not request, you must contact the appropriate Voya company immediately. Voya will not assume responsibility for such system failures and errors. WE ARE UNABLE TO EXECUTE TRANSACTIONS OR PROVIDE PERSONAL ACCOUNT INFORMATION VIA EMAIL, TEXT, SMS, SOCIAL MEDIA OR SIMILAR ONLINE OR ELECTRONIC COMMUNICATIONS.

myVoya and myVoyage

When you register for the myVoya or myVoyage portion of the Sites, you are voluntarily electing to receive services from Voya that will assist you with planning for retirement and other life goals (the “myVoya Services”). You agree that the myVoya Services are separate and apart from any other services that the Voya companies offering financial products and services may provide to you or your employer, including any services you may receive as a participant in a retirement plan. If you are a participant in a retirement plan and your employer has elected to make available the myVoya Services, then the myVoya Services will be included with the other services you receive as a participant in a retirement plan and a separate registration is not required. By registering for myVoya or myVoyage or otherwise utilizing the myVoya Services, you authorize Voya to use and disclose your account data for the purposes of authenticating your identity and providing the myVoya Services. You also authorize Voya to use the information you provide within myVoya for associated email communications regarding the myVoya experience. If you opt in to our marketing communications, you authorize Voya to use the information you provide to deliver relevant content and offers via email.

As part of myVoya Services, Voya may provide access to, or certain information regarding, accounts you hold with any of the Voya family of companies and with Pershing, LLC, which acts as custodian for certain brokerage and other accounts you may hold through Voya Financial Advisors, Inc. (“VFA”). The myVoya Services make this account information available to you as a courtesy, and Voya is not responsible for the accuracy of the information displayed. Please refer to the corresponding account statements, confirmations and other documents provided by our account custodian for information relating to your account, including account balance, asset holdings, positions and tax-reporting information.

Voya may also provide optional linking or account aggregation functionality that allows you to view, in a single location on the Sites or by linking from the Sites, consolidated financial information from such accounts that you maintain at various third-party financial institutions that you may designate. Data provided to VFA through linking or account aggregation may not be covered under the Securities Investor Protection Corporation (SIPC). VFA’s SIPC membership covers only those assets held at VFA. Certain other reported entities may be SIPC members that provide coverage for assets held there. You should contact your financial representative, or the other party, or refer to the other entity’s statement regarding SIPC coverage.

To use the account aggregate function, you understand and agree that:

  • The function is not available for all types of accounts and/or for all financial institutions.
  • Financial institutions may change their websites from time to time and as a result an outside account that was available may cease to be available through the Sites. Neither Voya nor its technology vendors have any control over this situation and have no obligation to restore the availability of an outside account on the Sites.
  • You are responsible for designating the outside accounts information which you desire to aggregate.
  • For each available outside account that you desire to aggregate on the Sites, you must provide the necessary login credentials to access the outside account such as username and password. You will provide this information through such function and process as our technology vendors may determine from time to time.

The account aggregation function will access the website maintained by each third-party financial institution for each outside account designated for aggregation in order to retrieve and store the account information within the outside account. This third-party account access may cause a Voya verification code to be sent to your mobile phone or email address.

  • You grant Voya and its technology vendors authority, with respect to each outside account designated for aggregation, to (1) use the login credentials for such outside account in order to access the account information within such outside account; (2) retrieve the account information within the outside account; and (3) store the account information so retrieved and display such information to you.
  • For each outside account designated for aggregation, you represent and warrant that (1) you are the legal owner of the account; (2) you have the right to disclose your login credentials for such outside account; and (3) you have the right to grant the foregoing authorization.
  • Neither Voya nor its technology vendors are responsible for any acts, errors or omissions by the financial institutions at which you maintain an outside account, or for the accuracy of the information provided by such institutions.

Voya may terminate your access to account information at the Voya family of companies and Pershing, LLC, and the account aggregation function at any time without notice.

Your Password

Transactions are protected by your individual password. Your password should not be shared. As an added measure of protection, once you have entered your online password, your session will automatically log off after 15 minutes of inactivity.

Miscellaneous

Voya is not responsible for any data inaccurately provided by policyholder or a third-party service provider, nor for any data lost due to power outage, delay in operation or transmission, computer virus, communication line failure, or for theft, alteration, or destruction of records by unauthorized persons.

Entire Agreement

These Terms and any other document referred to in these Terms, represent the entire agreement between Voya and you relating to your use of the Sites.

Severability

If any provision of these Terms is deemed unlawful, void or for any reason unenforceable, then that provision will be deemed severed from these Terms and the remaining provisions will remain in full force and effect.

Section Headings

Section headings in these Terms are for convenience or reference only and shall not govern the interpretation of any provision of these Terms.

This Addendum explains how the Voya Sites use cookies and similar technologies (“Cookie Addendum”). In some cases, Voya may use cookies and similar technologies to collect personal information or information that becomes personal information when combined with other information. In such cases, this Cookie Addendum will apply in addition to the Privacy Notice.

Monitoring

Please be aware that although passwords or other security protections may be in use, Voya reserves the right to monitor any and all transmissions, stored messages and routine backup copies of communications to ensure appropriate system usage. Voya may monitor and record all or portions of your telephone calls, emails, text messages, chats and other communications with Voya for quality control, customer service, employee training, security, legal, compliance and other lawful purposes. You hereby consent to such recording. Such consent is ongoing and need not be confirmed prior to, or during, such monitoring or recording. Unless required by law, Voya does not have any obligation to you to conduct such monitoring or to take any action based on any monitoring Voya may conduct. If you do not consent to such monitoring, you should not access the Sites.

Cookies

Voya and our service providers may use encrypted or non-encrypted cookies in connection with the Sites. Cookies are pieces of information that a website places in a file on your computer associated with your browser that may be used to deliver content specific to your interests and for other purposes, such as security, optimization testing of digital pages and other account administrative functions. A persistent cookie remains stored even after the internet browser has been closed and can be used by your internet browser on subsequent visits to our website. This information is processed passively by your browser as you surf through the Sites. Voya also uses third-party cookies in connection with the services provided through our website. Cookies do not cause damage to your computer systems or files.

If you do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows you to automatically decline cookies, or to be given the choice of declining or accepting the transfer of a particular cookie, or cookies from a particular website to your computer. In addition, Voya uses Google Analytics software to collect information about how you use the Sites. We do this to help make sure the Sites are meeting the needs of our users and to help us make improvements. Google Analytics stores information about the pages you visit on the Sites, how long you spend on each page, how you got to the Sites, and what you click on while you are visiting the Sites. To the extent any of the information collected by Google Analytics constitutes your personal information, this information will be used and disclosed in accordance with the applicable Voya Privacy Notice and (as applicable) the Supplemental State-Specific Privacy Notice. We do not allow Google to use or share our analytics data. You can opt out of Google Analytics cookies.

Voya has also implemented reCAPTCHA on certain Sites. reCAPTCHA works by collecting hardware and software information, such as device and application data and the results of integrity checks and sending that data to Google for analysis. Your use of the reCAPTCHA is subject to the Google Privacy Policy and Google Terms of Service.

For certain Sites, Voya uses cookies and collects information in order to provide you with customized advertising, marketing content and information as well as track your entries and the status of promotions or other activities and services offered via the Sites. Tracking technologies also help maintain and improve the usability of the website (1) by determining whether there has been any contact between your computer and the Sites in the past, and (2) by identifying the most popular areas of the Sites.

Referrers, IP Addresses and Environmental Variables

Voya and its service providers may also collect “referrers” information, IP addresses and various environmental variables.

  • A “referrer” is information the web browser passes along to Voya’s web servers that references the URL from which you came.
  • An “IP address” is a number used by computers on the network to identify your computer so that data can be transmitted to you.
  • “Environmental variables” include, among other things, the domain from which you access the internet, the time you accessed the Sites, the type of web browser and operating system or platform used, the internet address of the website you left to visit the Sites, the names of the pages you visit while at the Sites, and the internet address of the website you then visit.

Pixel Tags

Voya and its service providers may also use so-called “pixel tags,” “web beacons,” “clear GIFs” or similar means (collectively, “Pixel Tags”) in connection with some website pages and HTML-formatted email messages to, among other things, compile aggregate statistics about site usage, response rates and the effectiveness of advertising campaigns. A Pixel Tag is an electronic image, often a single pixel (1x1), that is ordinarily not visible to site visitors and may be associated with cookies on the visitors’ hard drives. Pixel Tags allow Voya to count users who have visited certain pages of the Sites, to deliver branded services, and to help determine the effectiveness of promotional or advertising campaigns. When used in HTML-formatted email messages, Pixel Tags can tell the sender whether and when the email has been opened.

  • YouTube is operated by YouTube LLC, headquartered at 901 Cherry Avenue, San Bruno, CA 94066, USA.
  • YouTube is represented by Google Inc., based in 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
  • SoundCloud is operated by SoundCloud Limited, headquartered at 33 St James Square, London SW1Y 4JS, UK.

All plug-ins are labeled with the brand of the respective operator (the “Operators”): Facebook, X, LinkedIn, YouTube and SoundCloud.

When you visit the web page that contains a social network plug-in (e.g., social sharing), your browser creates a direct connection to the operator’s servers. The operator submits the content of the plug-in directly to your browser, which embeds it in the web page, thereby enabling the operator to obtain the information that you have accessed on the corresponding sub-page of the Sites. Voya has no control over the data collected by the plug-in, and you acknowledge that the embedded plug-ins inform the operator that you have accessed the corresponding sub-page of the Sites. If you do not want this information to be transmitted to the operators, you must log out of your respective account with them before visiting our website.

When you visit and navigate the Sites and when you communicate with Voya via the Sites, Voya and third parties with whom Voya has contracted may collect technical and navigational information (such as a catalog of the site pages you visit) and online identifiers from cookies, referrers, IP addresses, environmental variables, pixel tags and similar technologies.
