Florida & Georgia: Voya Financial® Insurance Companies’ Response to Hurricane Irma

On behalf of Voya Financial’s insurers (ReliaStar Life Insurance Company, ReliaStar Life Insurance Company of New York, Midwestern United Life Insurance Company, Security Life of Denver Insurance Company, Voya Retirement Insurance and Annuity Company, and Voya Insurance and Annuity Company), we extend our deepest sympathies to those who have been adversely impacted by Hurricane Irma.

The Florida Office of Insurance Regulation and Georgia Office of Insurance and Safety Fire Commissioner recently issued emergency orders and directives to assist residents impacted by Hurricane Irma.

Voya Financial insurance companies will provide an extended grace period to its affected policyholders with respect to the potential lapse or termination of our clients’ life insurance policies and/or any timesensitive features of those policies, including premium payments. These time-sensitive features may vary depending on the type of life insurance policy or annuity contract. Please see below for state specific information.

Florida Residents

Voya Financial insurers will provide an extended grace period for time-sensitive features or notices that occur between August 25, 2017 through October 15, 2017. Consumers will have until December 16th to make any missed premium payments, or election of time-sensitive features.

If impacted customers receive, or have previously received, notices dated between August 25, 2017 and October 15, 2017 indicating their policy is in danger of lapsing or has terminated, please rest assured the grace period associated with the required premium payment has been extended. After October 15, 2017, the Voya Financial insurers will send billings and notices reflecting the total amount due and payable to maintain coverage at that time. The amount billed will include any unpaid premium payments currently owed, plus the premiums required during the extended grace period referenced above.

Georgia Residents

Voya Financial insurers will provide an extended grace period for time-sensitive features or notices that occur between September 10, 2017 through September 30, 2017. Consumers will have a 60 day grace period to make any missed premium payments, or election of time-sensitive features.

New York: Confidentiality and domestic violence (NY Law 2612; Reg 168)

New York Insurance Law § 2612, with respect to all insurers regulated under the Insurance Law, including health maintenance organizations (“HMOs”), provides in relevant part that if any person covered by an insurance policy delivers to the insurer a valid order of protection against the policyholder or other person covered by the policy, then the insurer is prohibited for the duration of the order from disclosing to the policyholder or other person the address and telephone number of the insured, or of any person or entity providing covered services to the insured. If a child is a covered person, then the right established by this section may be asserted by the child’s parent or guardian.

Effective January 1, 2013, Insurance Law § 2612 also requires a health insurer, as defined in that section, to accommodate a reasonable request made by a person covered by an insurance policy or contract to receive communications of claim‐related information by alternative means or at alternative locations if the person clearly states that disclosure of the information could endanger the person If a child is the covered person, then this right may be asserted by the child’s parent or guardian.

Except with the express consent of the person making the request, a health insurer may not disclose to the policyholder: (1) the address, telephone number, or any other personally identifying information of the person who made the request or child for whose benefit a request was made; (2) the nature of the health care services provided; or (3) the name or address of the provider of the covered services.

The New York State Department of Financial Services (“Department”) has promulgated 11 NYCRR 244 (Insurance Regulation 168) which requires insurers to develop and implement confidentiality protocols. For health insurers, this also must include written procedures by which a person may make a reasonable request to receive communications of claim‐related information by alternative means or at alternative locations and procedures for revoking such a request.

The Department also has drafted a model confidential communication request form that a health insurer may require a person submit when making a reasonable request. Illinois: Confidentiality and domestic violence (IL Law 215 ILCS 5/355b)

Illinois Law 215 ILCS 5/355b requires all health insurers to accommodate a reasonable request by an insured to receive insurer communications of claim or billing related information by alternative means or at alternative locations if the insured clearly states that disclosure of all or part of the information could endanger him or her.

Illinois: Voya Financial® Insurance Companies’ Response to Illinois Disaster Declaration

On behalf of Voya Financial’s insurers (ReliaStar Life Insurance Company, ReliaStar Life Insurance Company of New York, Midwestern United Life Insurance Company, Security Life of Denver Insurance Company, Voya Retirement Insurance and Annuity Company, and Voya Insurance and Annuity Company), we extend our deepest sympathies to residents of Illinois whose lives have been adversely impacted by recent severe storm and flooding activity.
 
The Illinois Department of Insurance recently issued Company Bulletin 2017-03 (the “Bulletin”) to assist residents of Cook, Kane, Lake, and McHenry counties. The Bulletin establishes limits on the cancellation and non-renewal of insurance coverage for victims affected by this disaster and provides alternative procedures for the cancellation and non-renewal of policies under certain conditions.
 
In accordance with the Bulletin, the Voya Financial insurance companies intend to provide the appropriate relief to its affected policyholders with respect to the potential lapse or termination of our clients’ life insurance policies and/or any time-sensitive features of those policies. These time-sensitive features may vary depending on the type of life insurance policy or annuity contract.
 
Persons to whom the Bulletin applies may disregard any grace period, lapse-pending, cancellation, or non-renewal notices sent by the Voya Financial life companies dated between July 12, 2017 and September, 30 2017. Such policyholders who receive such notices from the Voya Financial life companies will have their grace periods extended an additional 60 days (November 30, 2017) to remit the required premium payments. By temporarily amending our business rules to meet these requirements, affected policyholders will continue to receive valuable life insurance coverage through this extended grace period. After September 30, 2017, the Voya Financial life companies will send billings and notices reflecting the total amount due and payable to maintain coverage at that time. The amount billed will include any unpaid premium payments currently owed, plus the premiums required during the extended grace period referenced above.
 
Death claims will be honored for affected policies lapsing on the company’s administrative systems between July 12, 2017 and September 30, 2017, but past due premium payments may be deducted from the death benefit amount paid. Further, all time sensitive features required to be exercised by affected policyholders between July 12, 2017, and September 30, 2017 will be extended to November 30, 2017.

Texas: Voya Financial® Insurance Companies’ Response to Hurricane Harvey

The Texas Department of Insurance recently issued Commissioner's Bulletin #B-0009-17 (the “Bulletin”) to assist residents of counties impacted by Hurricane Harvey. The Bulletin encourages carriers to provide relief to policyholders in counties covered by the governor’s proclamations.

Voya Financial insurance companies intend to provide a 60 day grace period to its affected policyholders with respect to the potential lapse or termination of our clients’ life insurance policies and/or any time-sensitive features of those policies, including premium payments. These time-sensitive features may vary depending on the type of life insurance policy or annuity contract. Voya Financial insurers will provide the grace period for time-sensitive features or notices that occur between August 23, 2017 through October 31, 2017.
